Regulatory Changes

The decision of the Court of Justice of the European Union of October 1st, 2019 which applied for the first time the principles of the GDPR (General Data Protection Regulation) on the websites and guidelines of the European Data Protection Committee (EDPB) of May 2020 have clarified that the consent to the use of cookies cannot be considered valid if it does not respect certain requirements.

In particular, among other things, it is mandatory that:

  • the user's consent is not validly expressed through a pre-selected checkbox, or by just scrolling down despite being happening on many websites;
  • the web surfers must be able to granularly choose which cookies to accept and which not. Therefore, they must be able to choose, for example, whether to accept that preference cookies are collected from his web surfing but not the marketing ones, although the latter allow the setting up of targeted remarketing actions;
  • every website blocks the use of cookies before having collected specific consent for that type of cookies.

Today, more than 90% of websites, corporate level as well, are not fully compliant to the regulations, exposing companies to heavy fines, that can reach up to 20 million euros or to 4% of the total annual turnover.
